DQF PORTAL Terms of Service
Effective Date: January 30, 2026
1. Acceptance
By creating an account, starting a trial, or paying for a subscription, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Who We Are
DQFportal.com (“DQF PORTAL,” “we,” “us”) provides web-based compliance tools for U.S. motor carriers to manage Driver Qualification Files (DQF). We are not a law firm, insurance agency, or government agency (such as the FMCSA or DOT) and do not provide legal or professional compliance advice.
3. Eligibility & Accounts
You must be at least 18 years old and provide accurate information. The Service is intended solely for motor carriers operating in the United States. You represent that you are based in the U.S. and your use complies with all applicable federal (FMCSA/DOT), state, and local laws.
4. Subscriptions, Per-DQF Billing & Trials
- Plans. Subscriptions are billed in advance on an annual basis.
- Per-DQF Pricing. Fees are calculated based on the number of active Driver Qualification Files managed within the portal. You will be billed for the number of DQF slots selected at checkout or added during your term.
- Auto-renewal. Subscriptions renew automatically until canceled. You authorize us (and our payment processor) to charge your payment method each term.
- Trials. Free trials convert to paid subscriptions unless canceled before the trial ends.
- Price changes. We may change prices or features with at least 30 days' notice.
- Taxes. Prices exclude applicable taxes, which are your responsibility.
5. Cancellation, Scaling & Refunds
- Cancellation. Cancel via your account or by emailing Support@DQFportal.com at least 72 hours before renewal.
- Scaling. Adding additional DQF slots during a billing cycle will result in a prorated charge for the remainder of the current term. Reducing DQF slots takes effect at the next renewal date.
- Access. Access continues through the end of the current paid term.
- Refunds. Fees are non-refundable except where required by law.
6. Payment Processing
Payments are processed by Stripe, Inc. We do not store full credit card numbers. Stripe handles payment security under PCI-DSS standards. We may suspend access for failed payments.
7. Your Content & Compliance Responsibility
- Accuracy. You are responsible for the accuracy and completeness of driver data, including MVRs, medical certificates, and road tests.
- FMCSA Compliance. While DQF PORTAL provides tools to assist with recordkeeping, you are the regulated "Motor Carrier" and remain solely responsible for ensuring your drivers meet all 49 CFR Part 391 requirements.
- Authority. You represent that you have authority to manage data for the drivers associated with your account.
8. License
You grant us a non-exclusive, worldwide, royalty-free license to host, process, and display driver data solely to provide the Service to you.
9. Service Rules
You may not misuse the Service, reverse-engineer it, scrape data, or use the Service to infringe upon the privacy rights of drivers.
10. Intellectual Property
The Service and all related intellectual property belong to DQF PORTAL or its licensors.
11. Third-Party Services
We may integrate with third-party services (e.g., MVR providers). We are not responsible for the accuracy or availability of data provided by these third parties.
12. Confidentiality & Security
We use reasonable safeguards to protect sensitive driver information (SSNs, CDL numbers). You are responsible for securing your account credentials.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES. WE DO NOT GUARANTEE THAT USE OF THE SERVICE WILL PREVENT DOT FINES, PENALTIES, OR UNSATISFACTORY SAFETY RATINGS.
14. Limitation of Liability
Total liability is limited to fees paid in the preceding 12 months.
15. Indemnification
You agree to indemnify DQF PORTAL against claims arising from your misuse of the Service or failure to maintain regulatory compliance.
16. Governing Law & Disputes
DQF PORTAL’s parent company is organized under Wyoming law. Disputes are resolved by binding arbitration under AAA Commercial Rules in Wyoming. No class actions are permitted. You may opt out of arbitration within 30 days by emailing Support@DQFportal.com.
